1. Acceptance of terms

By creating an account or using Placesite AI ("the Service"), you agree to these Terms of Use. If you do not agree, do not use the Service. These terms apply to all users, free and paid.

2. Description of service

Placesite AI generates static websites from publicly available Google Business Profile data. You provide a Google Maps link; we scrape business information, generate AI content, and publish a website on a Placesite AI subdomain or your custom domain.

Content is generated by AI from scraped public data. We do not verify the accuracy or completeness of business information. You are responsible for reviewing and correcting all generated content before publishing.

3. Accounts

• You must provide a valid email address and keep your password secure.
• You are responsible for all activity under your account.
• Free accounts are limited to 1 generated website and 3 generation attempts per 24 hours.
• You must be at least 16 years old to use the Service.

4. Acceptable use

4a. Prohibited platform activities

You agree not to:

• Generate websites for businesses you do not represent or have explicit permission to represent.
• Attempt to circumvent rate limits, abuse the generation system, or reverse-engineer the Service.
• Resell or sublicense access to the Service without our written consent.
• Use automated tools, bots, or scripts to generate websites in bulk without prior written agreement.
• Share account credentials with third parties or allow others to access your account.

4b. Prohibited content on published websites

You may not publish or host websites containing:

• Pornographic, sexually explicit, or adult-only content of any kind.
• Hate speech, content promoting discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
• Threats of violence, incitement to violence, or terrorist content.
• Child sexual abuse material (CSAM) or any content that sexually exploits minors. Such content will result in immediate suspension, permanent account termination, and reporting to law enforcement and relevant authorities.
• Phishing pages, sites impersonating other businesses or individuals, or content designed to deceive users into disclosing personal or financial information.
• Malware, spyware, ransomware, or any malicious scripts or code.
• Websites for fictitious, non-existent, or fraudulent businesses.
• Content promoting or facilitating illegal activities, including but not limited to the sale of drugs, weapons, or trafficking of persons.
• Content that infringes the intellectual property rights, trademarks, or trade secrets of any third party.

4c. Your responsibility for published content

You are solely responsible for all content published on your generated websites, including content generated by AI on your behalf. Placesite AI does not pre-screen or verify the accuracy of business data or AI-generated content. AI-generated content may contain errors, inaccuracies, or outdated information — you have an obligation to review and verify all content before publishing.

5. Content monitoring and enforcement

We reserve the right — but not the obligation — to monitor, review, and scan published websites for compliance with these Terms. We may, at our sole discretion and at any time, without notice:

• Unpublish or suspend individual websites that violate these Terms, regardless of account standing.
• Suspend or terminate accounts responsible for repeated or severe violations.
• Remove or disable access to content that we believe is unlawful, harmful, or in violation of these Terms.
• Report illegal content, including CSAM and fraud, to the relevant authorities and law enforcement agencies.

For imminent harm (including CSAM, active phishing operations, and active malware distribution), we will act immediately without prior notice. For other violations we will typically attempt to notify you first via email, but we are under no obligation to do so.

Our enforcement decisions are final. If you believe a takedown was made in error, contact [email protected] with details and we will review your case.

6. Abuse reporting and DMCA

Reporting abuse

If you find a Placesite AI-hosted website that you believe violates these Terms of Use, please report it by emailing [email protected] with the URL of the website and a description of the violation. We review all reports and take appropriate action.

Copyright / DMCA takedown

If you believe that content on a Placesite AI-hosted website infringes your copyright, please send a takedown notice to [email protected] including:

• Your contact information (name, email address, and telephone number).
• Identification of the copyrighted work you claim has been infringed.
• The URL(s) of the allegedly infringing content on our platform.
• A statement that you have a good faith belief that use of the material is not authorized by the copyright owner.
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
• Your physical or electronic signature.

We will process valid notices promptly and notify the site owner. Repeated infringers will have their accounts terminated.

7. Intellectual property

You retain ownership of your business data and any content you upload (logos, photos, text edits). The AI-generated content is provided to you under a non-exclusive license for use on your generated website. We retain ownership of the Placesite AI platform, templates, and tooling.

8. Payments and subscriptions

• Paid plans are billed yearly per website via Stripe.
• All prices are in euros (€) and exclude applicable taxes.
• Subscriptions auto-renew unless cancelled before the renewal date.
• Refunds are handled on a case-by-case basis — contact us within 14 days of purchase.
• We reserve the right to change pricing with 30 days notice to existing subscribers.

9. Availability and uptime

We aim for high availability but do not guarantee 100% uptime. We may perform maintenance with or without notice. We are not liable for losses resulting from downtime.

10. Limitation of liability

The Service is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages, including lost revenue or data, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the last 12 months.

We are not liable for any content published by users on their generated websites, including damages arising from inaccurate, misleading, or unlawful content hosted on user-generated sites.

11. Termination

You may delete your account at any time from your account settings. We may, at our discretion:

• Unpublish individual websites for Terms of Use violations without terminating your account.
• Suspend your account temporarily pending investigation of a reported violation.
• Terminate your account for repeated or serious violations, with or without prior notice.

No refund will be issued if an account or individual website is terminated or unpublished due to a violation of these Terms.

Upon account termination, your data and generated websites will be deleted within 30 days. Websites that are unpublished (but not deleted) for a violation remain accessible in your panel and may be republished after you correct the violation and we confirm compliance.

12. Governing law

These terms are governed by Polish law. Any disputes shall be resolved in the courts of Poland, unless mandatory consumer protection laws in your country provide otherwise.

For users in the European Union, we comply with the EU Digital Services Act (DSA) and applicable national laws implementing the DSA.

13. Changes to these terms

We may update these terms. We will notify users by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
